Case Note & Summary
The case involves an appeal filed by Shri Braz Cardozo and his wife against an order of the Civil Judge, Senior Division, Margao, which granted a temporary injunction in favor of the respondent, Smt. Tereza Rodrigues, regarding a suit property. The appellants challenged the injunction order. The High Court noted that the suit was filed in 2001 and the injunction had been operative for over four years. The court observed that the suit should be ripe for hearing and that it would be more appropriate to expedite the trial rather than adjudicate the interim proceedings at the appellate stage. Consequently, the court directed the Civil Judge to expedite the hearing and complete the adjudication within one year from receipt of the court's writ. The appeal was disposed of with no order as to costs.

Ratio Decidendi
When an interim injunction has been operative for a long period and the suit is pending, the appellate court may decline to adjudicate the interim proceedings and instead direct expeditious disposal of the suit on merits to serve the interests of both parties.
Judgment Excerpts
In my considered view, the suit which is filed in the year 2001 must be right for hearing and if its not right it should be made right for hearing as expeditiously as possible and interest of both the parties would be served if the suit itself if adjudicated on merits, instead of adjudicating the interim proceedings at the appellate stage at this juncture.
