The petitioner, Narayan Korga Pujari, filed a writ petition challenging the seniority list fixed by respondent No.1 (Gandhi Education Society) and approved by respondent No.2 (Education Officer), wherein he was shown junior to respondent Nos.3 and 4 (N.J. Jaunjal and S.B. Chavan). The petitioner was initially appointed as an untrained teacher in the institution run by respondent No.1. Subsequently, respondent Nos.3 and 4 were also appointed as untrained teachers. All three teachers acquired the B.Ed degree on the same day, i.e., 10th June 1975. The dispute centered on the interpretation of Note-3 to clause (2) of Schedule F of the Maharashtra Employees of Private Schools Rules, 1981. The petitioner argued that since all three entered the trained category on the same date, their seniority should be determined by their respective dates of initial appointment as untrained teachers, which would make him senior to respondent Nos.3 and 4. The respondents contended that seniority should be based on the date of acquiring the training qualification. The court, after hearing the advocates, held that Note-3 applies only when teachers enter the trained category on different dates. When they enter on the same date, the seniority must be determined by the date of initial appointment as untrained teachers. Accordingly, the court allowed the petition, quashed the impugned seniority list, and directed the respondents to prepare a fresh seniority list in accordance with this principle.
