The petitioners, five women rescued from a brothel in Pune on 27 April 2006, were produced before the Magistrate on 28 April 2006. The Magistrate directed their detention in custody. They applied for release, but the Magistrate rejected their prayer on the ground that they must show their bonafides. The women filed a writ petition before the Bombay High Court challenging the detention. The court held that under the Immoral Traffic (Prevention) Act, 1956, the Magistrate is required to hold an enquiry and can detain the rescued persons only during that enquiry, which must be completed within three weeks. The condition of showing bonafides is not a valid ground for continued detention. The court directed the Magistrate to release the petitioners on their executing a bond of good behaviour and to complete the enquiry within three weeks from the date of production. The petition was disposed of accordingly.
