The Petitioner, Pramod Devaram Bhangale, was appointed as an Assistant Teacher in Vidya Prasarak Mandal's Secondary School, Balkum, Thane on 9th June 1980. He later became Head Master on 31st October 1996 and Head of School on 4th November 1996. Respondent No.5, Arvind Ramchandra Bhalerao, was appointed as an Assistant Teacher on 15th June 1981. The Education Officer, Zilla Parishad, Thane, passed an order on 18th February 1997 fixing the seniority of the Petitioner below Respondent No.5. The Petitioner challenged this order, contending that it contravened the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 (MEPS Rules). The Court examined the relevant facts and the applicable law, particularly Rule 12 of the MEPS Rules, which governs seniority. The Court noted that the Petitioner had acquired D.Ed. in 1977, B.Ed. in 1984, and M.Ed. in 1994, while Respondent No.5 had acquired B.Ed. in 1984.
