The case originated from the disappearance of Yadav Navkar on 3 September 2000. His wife Kausalyabai filed a missing person report on 18 September 2000. She subsequently discovered that a general power of attorney purportedly executed by her husband on 30 June 2000 was used by accused no. 1 Ajay Galat to sell her husband's land to accused nos. 2 to 4 via a sale deed dated 8 August 2000. She filed a complaint on 14 October 2000 suspecting accused no. 1 in the murder of her husband. In the meantime, a dead body was found in Madhya Pradesh and identified as Yadav Navkar by his wife and brother. An accomplice, Sunil Manmote, surrendered and narrated the events leading to the murder, implicating accused no. 1. The prosecution alleged that accused no. 1, with the conspiracy of accused nos. 2 to 4, kidnapped Yadav Navkar, murdered him by hitting him with a jack and a bottle, and forged documents to transfer his property. The trial court convicted accused no. 1 under Sections 364, 302, 467, 468, 471 r/w 120-B IPC and sentenced him to death, while accused nos. 2 to 4 were convicted under the same sections and sentenced to life imprisonment. The State submitted the case for confirmation of the death sentence, and the convicted accused filed appeals. The High Court heard the confirmation case and appeals together.

On 18 September, 2000 Kausalyabai Yadav Navkar filed report with Civil Lines Police Station, Akola stating that her husband Yadav Navkar had left the house on 3 September, 2000 at about 9 O'clock and he had stated he will return within half an hour but he had not returned.
She suspected the role of accused no.1 in commission of murder of her husband.
Accused no.1 then took out the jack and rushed to the rear side and hit Yadav Navkar with the jack on his head.
