The petitioner, Gopal G. Nipane, was employed by Hindustan Aeronautics Ltd. (HAL) as a Senior Manager. He was recruited against a reserved post for Scheduled Tribe candidates based on a school leaving certificate showing he belonged to the Halba Scheduled Tribe. He joined as a Management Trainee in 1978 and was later promoted. Subsequently, his caste claim was challenged, and it was found that Halba is not a Scheduled Tribe in the State of Maharashtra. Consequently, his appointment was invalid, and he was dismissed from service. The petitioner challenged his dismissal by way of a writ petition before the Bombay High Court. The court examined the issue of whether the petitioner's appointment against a reserved post was valid. The court noted that the petitioner's caste 'Halba' is not recognized as a Scheduled Tribe in Maharashtra. Therefore, the appointment against a reserved post was invalid.
