Case Note & Summary
The petitioner, Arun Ambadasji Chawade, was a retired employee of Bharat Sanchar Nigam Ltd. (BSNL), having served as a Phone Mechanic and retired on 31 March 2009. On 8 January 2013, the respondent No.4 issued a communication directing the petitioner to deposit an overpaid salary amount of Rs.1,49,504. The petitioner challenged this communication by way of a writ petition before the Bombay High Court, Nagpur Bench. The main legal issue was whether the recovery of overpaid salary from a retired employee, without issuing a show cause notice and without any misrepresentation by the employee, is sustainable. The petitioner argued that the communication was issued without any show cause notice and without any reasons, and that the overpayment was not due to any fraud or misrepresentation on his part. The respondents contended that the recovery was justified as the amount was overpaid. The court, after hearing both sides, held that the impugned communication was issued without any show cause notice and without any reasons, and that the overpayment was not on account of any misrepresentation by the petitioner. Therefore, the recovery could not be sustained. The court quashed the communication dated 8 January 2013 and allowed the writ petition. The rule was made absolute with no order as to costs.
