Case Note & Summary

The petitioner, Arjun Ratansing Jadhav, was the highest bidder in an auction for collection of gum from Chalisgaon forest area for the period 26.11.2008 to 30.6.2009. He was allotted a godown at Hirapur, Taluka Chalisgaon, and received transit passes to transport the gum from the forest range to the godown. The petitioner transported the gum from Chalisgaon to his village Pal in Taluka Raver, District Jalgaon, where he intended to store it temporarily. However, forest officials at Pal seized the gum and sealed it in two rooms of his house. The petitioner challenged this seizure as illegal, arguing that he had valid transit passes and the gum was being transported to his allotted godown. The respondents, including the State of Maharashtra and forest officials, opposed the petition, claiming that the gum was seized because it was being transported beyond the permitted area. The court examined the documents, including the transit passes, and found that the passes allowed transport from Chalisgaon to Pal. The court held that the seizure was without authority as the forest officials at Pal had no jurisdiction to seize gum that was being transported under valid passes from another range. The court allowed the petition, directing the respondents to release the gum or pay compensation.
