Case Note & Summary
The case involves an appeal by Shri Lazaro Reginaldo Steivan Amyn de Souza against the State of Goa and the Deputy Collector/LAO, challenging the dismissal of his suit for recovery of interest on compensation for land acquired in 1975. The land, measuring 542.36 square metres in Vasco city, was acquired for construction of a Tourist Hostel. The Land Acquisition Officer passed an Award on 25.03.1975 for compensation, but due to a dispute among co-heirs regarding entitlement, the matter was referred to the Civil Court under Section 30 of the Land Acquisition Act, 1894. The dispute was finally resolved by the High Court in First Appeal No. 76 of 1984, decided on 02.09.1996, determining the appellant's share. Thereafter, in 1999, the appellant claimed the compensation amount of Rs.70,704/- from the Land Acquisition Officer, which was paid without any interest. The appellant then issued a notice under Section 80 CPC and filed Regular Civil Suit No. 125 of 2001 before the District Judge for recovery of interest. The respondents opposed the suit, contending that the amount accrued only in 1996 after the share was determined, and that the claim was barred by limitation. The trial court dismissed the suit. The High Court framed the issues of entitlement to interest from the date of award and limitation. The appellant argued that interest under Section 34 of the Land Acquisition Act accrues from the date of award, and the delay due to the dispute should not deprive him of interest. The respondents argued that interest is payable only from the date of determination of shares. The court analyzed Section 34, which provides for interest on compensation from the date of taking possession until payment. It held that the appellant is entitled to interest from the date of the Award (1975) until the date of payment (1999), as the dispute among co-heirs does not affect the liability to pay interest. Regarding limitation, the court held that the cause of action for interest arose when the principal was paid without interest in 1999, and the suit filed in 2001 is within the three-year period under Article 113 of the Limitation Act. The court allowed the appeal, set aside the trial court's judgment, and directed the respondents to pay interest at the rate of 9% per annum from 25.03.1975 to 31.12.1999 on the compensation amount of Rs.70,704/-, within three months.
Headnote
A) Land Acquisition - Interest on Compensation - Entitlement from Date of Award - Land Acquisition Act, 1894, Sections 30, 34 - The appellant claimed interest on compensation awarded in 1975 but paid in 1999 after dispute among co-heirs was resolved in 1996. The court held that interest under Section 34 of the Act accrues from the date of award, not from the date of determination of shares, and the appellant is entitled to interest for the period of delay caused by the dispute. (Paras 2-6) B) Limitation - Recovery of Interest - Suit for Interest on Compensation - Limitation Act, 1963, Article 113 - The suit for recovery of interest was filed in 2001 after the principal was paid in 1999. The court held that the cause of action for interest arose when the principal was paid without interest, and the suit is within limitation as per Article 113 (three years from when the right to sue accrues). (Paras 7-8) C) Civil Procedure - Notice under Section 80 CPC - Mandatory Requirement - Code of Civil Procedure, 1908, Section 80 - The appellant issued a notice under Section 80 CPC before filing the suit, which was complied with. The court noted that the requirement of notice is mandatory for suits against the government. (Para 3)
