Case Note & Summary

The petitioner, Laxmikant s/o Ramkrishna Dharmik, was appointed in 1997 based on a caste certificate certifying him as belonging to the 'Halba Scheduled Tribe'. On 21 June 2013, respondent no. 2 (Joint District Registrar & Collector of Stamps, Wardha) issued a notice directing the petitioner to submit his caste certificate by 31 July 2013. The petitioner filed the present writ petition on 5 August 2013, seeking protection from coercive action. The Bombay High Court, Nagpur Bench, considered the averments and relied on its earlier judgment in Ku. Vijaya Deorao Nandanwar v. Chief Officer, Municipal Council, Wardha (W.P. No. 5530/12 & ors., dated 10 July 2013). The Court found that a prima facie case was made out but noted that an alternate remedy was available to the petitioner. Consequently, the Court permitted the petitioner to withdraw the petition with liberty to approach the appropriate forum within four weeks. The Court clarified that the protective order does not operate as a stay on the impugned notice, but directed that no coercive steps be taken against the petitioner based on the notice for a period of four weeks. The petitioner was also given liberty to apply afresh for protection before the appropriate forum. All points were kept open, and the writ petition was disposed of with no order as to costs.

Nature of Litigation

Writ petition seeking protection from coercive action based on a notice to submit caste certificate.

Remedy Sought

Petitioner sought protection from coercive steps/action based on the impugned notice dated 21.6.2013.

Filing Reason

Respondent no. 2 issued a notice directing the petitioner to submit his caste certificate by 31.7.2013, and the petitioner feared adverse action.

Previous Decisions

The Court relied on its earlier judgment in Ku. Vijaya Deorao Nandanwar v. Chief Officer, Municipal Council, Wardha (W.P. No. 5530/12 & ors., dated 10.7.2013).

Issues

Whether the petitioner is entitled to interim protection from coercive action pending verification of his caste certificate.

Submissions/Arguments

Petitioner argued that he has been in service since 1997 based on a valid caste certificate and that the notice is arbitrary. Respondents submitted that the notice was issued in compliance with Government Circular dated 18.2.2013.

Ratio Decidendi

Where a prima facie case is made out and an alternate remedy exists, the court may grant interim protection while permitting the petitioner to approach the appropriate forum, keeping all points open.

Judgment Excerpts

Considering the averments made and in view of judgment of this Court ... in the case of Ku. Vijaya Deorao Nandanwar ... we are inclined to extend protection to the petitioner at this stage, as prima facie case is made out. It is made clear that once the law is settled by Supreme Court as well as by this Court revolving around the said issue, the Court/Tribunal is required to consider the same while passing interim as well as final order arising out of such communication based upon the Government Circular dated 18.2.2013.

Procedural History

The petitioner was appointed in 1997 based on a caste certificate. On 21.6.2013, respondent no. 2 issued a notice to submit the caste certificate by 31.7.2013. The petitioner filed the writ petition on 5.8.2013. The Court heard the matter on 7.8.2013 and disposed of the petition with interim protection for four weeks.
