The appeal arises from an order of the learned Single Judge dated 18 June 2012 dismissing a Chamber Summons taken out by the Appellant for raising an attachment levied on immovable property. The property, office premises at A-1, Inder Mohini Co-operative Housing Society Ltd, Mumbai, was attached in execution of a decree passed on 5 April 2004 by the Third Senior Civil Judge, City Civil Court, Secunderabad, in favor of the First Respondent (TCI Finance Limited) against the Second and Third Respondents for Rs.78.39 lakhs with interest. The Appellant claimed title based on a registered deed of transfer dated 29 January 2005, executed prior to the attachment on 8 November 2006. The learned Single Judge dismissed the Chamber Summons, observing that no consideration was paid, the transaction was not bona fide, and the transfer was rightly rejected by the society. The Appellant appealed, contending that the Executing Court should have adjudicated the claim on merits rather than summarily rejecting it. The High Court allowed the appeal, set aside the impugned order, and remanded the Chamber Summons for fresh adjudication on merits, directing the Executing Court to consider the validity of the transfer and the claim of title after giving both parties an opportunity to lead evidence.
