Case Note & Summary
The petitioners, social workers from Kolhapur, filed a writ petition seeking directions from the Bombay High Court to compel the Municipal Corporation of Kolhapur or the State of Maharashtra to definitively determine the status of the Kolhapur Radha Nagari road. The core dispute was whether this road is a public street maintained by the Municipal Corporation or a State Highway governed by the Highways Act. The petitioners argued that the ambiguity in classification leads to inconsistent and potentially discriminatory building permissions along the road. The respondents, including the Municipal Corporation and the State, filed affidavits claiming the road is a public street, but the court noted contradictory statements and that the issue remained unresolved. The court observed that the classification directly affects the grant of building permissions, as the applicable rules differ for public streets and highways. To prevent discriminatory orders, the court directed the State of Maharashtra to decide the status of the road within six months. The judgment did not delve into the merits of the classification but focused on the need for a clear determination by the appropriate authority.
