Case Note & Summary
The dispute concerns a property at Calangute known as 'Sullachi Nhat' with a house, originally belonging to Joao Francisco Lobo and his wife. Joao Francisco Lobo died on 1.2.1998, and his wife predeceased him on 30.3.1979. The defendants are the widow and children of Savio Lobo, who died on 17.10.1984. Prior to his death, Joao Francisco Lobo executed a Will on 7.1.1997 in favour of plaintiff No.1 (Carlos Tavora). The plaintiffs filed a suit for possession, claiming title under the Will. The defendants contested, alleging the Will was not validly executed and that there were suspicious circumstances. The trial court decreed the suit in favour of the plaintiffs, leading to appeals by both parties. The High Court upheld the trial court's decision, finding that the Will was validly executed and attested, and that the propounder had discharged the burden of proving its genuineness. The court noted that the Will was registered, the attesting witnesses were examined, and no suspicious circumstances were established. The appeals were dismissed.
Headnote
A) Succession - Will - Execution and Attestation - Indian Succession Act, 1925, Sections 63, 68 - The court examined whether the Will was executed in accordance with law, considering the propounder's burden to dispel suspicious circumstances. Held that the Will was validly executed and attested, and the propounder successfully proved its genuineness (Paras 3-10). B) Evidence - Burden of Proof - Suspicious Circumstances - Indian Evidence Act, 1872, Section 101 - The court considered the standard of proof required when a Will is challenged on grounds of suspicious circumstances. Held that the propounder must remove all legitimate suspicions, which was done in this case (Paras 5-8).
Issue of Consideration
Whether the Will dated 7.1.1997 executed by Joao Francisco Lobo in favour of plaintiff No.1 was validly executed and attested, and whether the plaintiffs are entitled to possession of the suit property.
Final Decision
Both appeals dismissed. Judgment/Decree dated 31.12.2003 of the trial court upheld.
