The petitioner, M/s. Zia Iron Store, purchased an industrial property at N-69, M.I.D.C., Nagpur in an auction conducted in execution of an award of the Co-operative Court. The property previously belonged to M/s. Sumit Re-Rolling Mills Pvt. Ltd., which had defaulted on a loan from Nagpur Nagrik Sahakari Bank and also owed electricity dues of Rs. 36,61,321.45 to the respondent, Maharashtra State Electricity Distribution Co. Ltd. (M.S.E.D.C. Ltd.). After purchasing the property, the petitioner applied for a new electricity connection. The respondent refused the application by letter dated 9th September 2005, solely on the ground that the previous owner had outstanding electricity arrears. The petitioner filed a writ petition seeking a direction to the respondent to supply electricity without insisting on payment of the previous owner's dues.
