Case Note & Summary
The petitioner, M/s. Zia Iron Store, purchased an industrial property at N-69, M.I.D.C., Nagpur in an auction conducted in execution of an award of the Co-operative Court. The property previously belonged to M/s. Sumit Re-Rolling Mills Pvt. Ltd., which had defaulted on a loan from Nagpur Nagrik Sahakari Bank and also owed electricity dues of Rs. 36,61,321.45 to the respondent, Maharashtra State Electricity Distribution Co. Ltd. (M.S.E.D.C. Ltd.). After purchasing the property, the petitioner applied for a new electricity connection. The respondent refused the application by letter dated 9th September 2005, solely on the ground that the previous owner had outstanding electricity arrears. The petitioner filed a writ petition seeking a direction to the respondent to supply electricity without insisting on payment of the previous owner's dues. The court considered the legal issue of whether an auction purchaser is liable for the electricity dues of the previous owner. The petitioner argued that as an auction purchaser, it was not liable for the contractual dues of the earlier owner. The respondent resisted, presumably relying on its right to recover arrears. The court analyzed the provisions of the Electricity Act, 2003, particularly Section 43 which mandates the supply of electricity to any applicant, and Section 56 which deals with disconnection for non-payment but applies only to existing consumers. The court held that the petitioner, being a new applicant and not the previous consumer, could not be compelled to pay the arrears of the previous owner. The court directed the respondent to provide a new electricity connection to the petitioner without insisting on payment of the outstanding dues of M/s. Sumit Re-Rolling Mills Pvt. Ltd. The writ petition was allowed with no order as to costs.
