The petitioner, Ashok Shahaji Hivrale, filed a writ petition challenging the order of the Central Administrative Tribunal (CAT) dated 7-6-2000 in Original Application No. 1085 of 1994, and also sought quashing of a charge sheet issued on 20th July 2000. The CAT had allowed the original application, quashing penalty orders and a charge sheet dated 14-12-1992 as being issued by an incompetent authority. However, the CAT did not grant any relief regarding suspension or promotion to the post of Goods Guard. The petitioner contended that since the original application was allowed, the Tribunal could not have permitted the employer to issue a fresh charge sheet. The High Court examined the Tribunal's order and noted that in paragraph 17, the Tribunal had refrained from recording any opinion on whether a fresh charge sheet could be issued, as that was not the subject matter of the original application. The High Court found the petitioner's contention untenable. It observed that the fresh charge sheet dated 20th July 2000 was issued after the Tribunal's order, and the petitioner could raise all objections by answering the charge sheet, and if necessary, through departmental appeal and revision. The High Court dismissed the petition, holding that the petitioner had adequate remedies available.
