Case Note & Summary

The plaintiff, Satish S. Paralkar, filed a suit in the Bombay High Court seeking a declaration that he is the owner of flat no. 12 on the 4th floor of the building 'Navneet' at Dadar, Mumbai, and for consequential reliefs. The suit was based on a development agreement dated 19.4.1991 executed by the original owner, Mrs. Pushpa S. Paralkar, with defendant no. 7, the developer. Under the agreement, the developer was given rights to develop the property and sell flats on ownership basis, except the flat on the fifth floor which was allotted to the original owner. The plaintiff claimed ownership of the suit flat, but the court noted that the admitted position was that the flat on the fifth floor was allotted to the original owner, not the plaintiff. The plaintiff failed to produce any evidence of title or any agreement in his favor. The court examined clauses 25 and 26 of the development agreement, which required purchasers to join an association under the Maharashtra Apartment Ownership Act, 1976, and stated that conveyance would only be executed after formalities under the Act. The court held that the plaintiff had no right, title, or interest in the suit flat and dismissed the suit with no order as to costs.
