The State of Maharashtra filed a writ petition challenging the order of the Maharashtra Administrative Tribunal dated 27th November 1998 in Original Application No.163 of 1998. The respondent, Gopal Ananda Nagargoje, a retired Superintending Engineer, had claimed eligibility for consideration for promotion to the post of Chief Engineer as on 15th July 1997. He challenged the promotion of one Chavan to that post by filing Original Application No.505 of 1997, which was allowed. The Tribunal directed the State to consider the respondent's suitability for promotion to the post of Chief Engineer on the basis of relevant service record and, if suitable, to promote him forthwith. Chavan, who was promoted, retired on 31st July 1997. The State argued that the respondent was not eligible for promotion.
