Case Note & Summary

The case pertains to an appeal filed by the Special Land Acquisition Officer and the Chief Engineer of Konkan Railway Corporation Limited against the judgment and award dated 20.07.2001 passed by the Additional District Judge III (South) Margao in Land Acquisition Case No.216/95. The government acquired large chunks of land for the Konkan Railway Corporation Ltd. by notification dated 24.07.1991. The respondent, Sm. Champavati Vaikunt Dessai, had interest in an area of 4380 sq. metres bearing Survey Nos. 56/9, 50/6, 48/21, and 53/1 of Village Nagorcem Palolem. The respondent claimed 50% share from survey No.56/9 (300 sq. metres), survey No.50/6 (565 sq. metres), and survey No.48/21 (250 sq. metres) which were paddy fields, and 1/3rd share from Survey No.53/1 (3265 sq. metres) which was a coconut garden. The Special Land Acquisition Officer, by his award dated 9.12.1993, awarded Rs.9/- per sq. metre for paddy fields and Rs.17/- per sq. metre for coconut garden. Dissatisfied, the respondent sought reference under Section 18 of the Land Acquisition Act, 1894. The Reference Court enhanced the compensation to Rs.30/- per sq. metre for paddy fields and Rs.40/- per sq. metre for coconut garden. The appellants challenged this enhancement. The High Court examined the evidence, including a sale deed of 1990 for paddy fields at Rs.30/- per sq. metre, and considered the potential for development of the land. The court held that the Reference Court's enhancement was justified and dismissed the appeal, confirming the enhanced compensation with interest under Section 28 of the Act.

Headnote

A) Land Acquisition - Market Value Determination - Comparable Sale Deeds - The court considered the market value of acquired land based on sale deeds of similar lands in the vicinity, with appropriate deductions for development charges. Held that the Reference Court's enhancement was justified considering the potential for development and the sale deed of 1990 showing Rs.30/- per sq. metre for paddy fields. (Paras 3-6)

B) Land Acquisition - Classification of Land - Paddy Fields vs. Coconut Garden - The court distinguished between paddy fields and coconut garden, awarding higher compensation for coconut garden due to its potential for higher yield and development. Held that the Reference Court's award of Rs.40/- per sq. metre for coconut garden was reasonable. (Paras 2, 6)

C) Land Acquisition - Interest on Enhanced Compensation - Section 28 of Land Acquisition Act, 1894 - The court directed payment of interest on the enhanced compensation at the rate of 9% per annum for the first year and 15% per annum for the subsequent period from the date of taking possession. Held that the claimant is entitled to statutory interest. (Para 7)

Nature of Litigation

Appeal against enhancement of compensation in land acquisition case

Remedy Sought

Appellants sought to set aside the Reference Court's award enhancing compensation

Filing Reason

Appellants challenged the enhanced compensation awarded by the Additional District Judge

Previous Decisions

Special Land Acquisition Officer awarded Rs.9/- per sq. metre for paddy fields and Rs.17/- per sq. metre for coconut garden; Reference Court enhanced to Rs.30/- and Rs.40/- per sq. metre respectively

Issues

Whether the Reference Court was justified in enhancing compensation for paddy fields from Rs.9/- to Rs.30/- per sq. metre? Whether the Reference Court was justified in enhancing compensation for coconut garden from Rs.17/- to Rs.40/- per sq. metre?

Submissions/Arguments

Appellants argued that the enhancement was excessive and not based on proper evidence. Respondent argued that the compensation was inadequate considering the potential for development and comparable sale deeds.

Ratio Decidendi

The market value of acquired land should be determined based on comparable sale deeds of similar lands in the vicinity, with appropriate deductions for development charges. The potential for development of the land is a relevant factor for enhancement. The Reference Court's enhancement was justified as it was based on a sale deed of 1990 showing Rs.30/- per sq. metre for paddy fields, and the coconut garden had higher potential.

Judgment Excerpts

By this appeal, the appellants challenge Judgment and Award dated 20.07.2001, passed by the Additional District Judge III (South) Margao in Land Acquisition Case No.216/95. The Reference Court enhanced the compensation to Rs.30/- per sq. metre for paddy fields and Rs.40/- per sq. metre for coconut garden. In my opinion, the Reference Court was justified in enhancing the compensation.
