The appellant, Pradeep Balkrishna Gaikwad, was convicted under Section 302 of the Indian Penal Code, 1860 for the murder of Sambhaji. The prosecution case was that the appellant suspected his wife Pratiksha had an illicit relationship with the deceased. He confronted Sambhaji and asked his mother Ranjana (PW2) to question him. When Sambhaji denied the allegations, the appellant struck him on the head with an axe, causing his death. The trial court convicted the appellant and sentenced him to life imprisonment. In appeal, the appellant argued that the prosecution evidence was inconsistent and unbelievable, and that the recovery of the axe was not at his instance but was handed over by PW3. The High Court, after scrutinizing the evidence, found that the eye-witness account of PW2 was consistent and corroborated by the medical evidence which showed a homicidal death due to a head injury. The recovery of the axe was also found to be at the instance of the appellant. The court held that the prosecution had proved its case beyond reasonable doubt and dismissed the appeal, upholding the conviction and sentence.
