The accused Nitin Sahare (accused no. 2) came to the complainant's door and demanded removal of the vehicle, using abusive language. Accused Dinesh Sawale (accused no. 1) arrived and made remarks about a wall constructed by the complainant. Accused Madhuri (accused no. 3) brought an iron rod and started demolishing the wall. Dinesh went to his house and returned with a bamboo stick. In the ensuing scuffle, Dinesh struck the deceased (the complainant's brother) with the bamboo stick on the head, causing fatal injuries. The trial court convicted Dinesh under Section 302 IPC for murder and sentenced him to life imprisonment, while acquitting the other accused. The complainant appealed against the acquittal of the other accused. The High Court examined the evidence and found that the incident occurred suddenly without premeditation, arising from a sudden quarrel over parking. The court held that the case falls under Exception 4 to Section 300 IPC, as the fight was sudden and the accused did not act in a cruel or unusual manner.
