The petitioner, Kiran Kirit Solanki, was appointed as a staff nurse in 2008. She approached the Maharashtra Administrative Tribunal aggrieved by the recovery of increments due to her on the ground of non-passing of the Marathi Language Examination in terms of the Maharashtra Government Servants (Other than Judicial Department Servants) Marathi Language Examination Rules, 1987. The Rules require an employee to pass the examination within two years of appointment, and provide for withholding of increments until the examination is passed. The Tribunal dismissed her application. The High Court, in writ petition, examined the Rules and found that they only contemplate withholding of increments, not recovery of increments already paid. The court held that the recovery of increments already paid is unsustainable and set aside the recovery. The petition was allowed.
