The decree holder challenged this order by way of a writ petition before the Bombay High Court, Nagpur Bench. The respondents supported the impugned order, relying on judgments such as Ratansingh vs. Vijaysingh, Dr. Chiranji Lal vs. Hari Das, and Ram Bachan Rai vs. Ram Udar Rai, which held that a decree becomes inexecutable after the period prescribed under Article 136 expires.
