Case Note & Summary

The petitioner (plaintiff) instituted Special Suit No. 156 of 2010 (renumbered as 303 of 2012) for specific performance of a contract dated 04.03.2005 against Shivaji Harale. Upon Shivaji's death on 02.05.2011, his legal representatives were brought on record as defendants. These legal representatives subsequently filed Regular Civil Suit No. 579 of 2012 seeking a declaration that the contract dated 04.03.2005 was merely a security document for a loan advanced by the petitioner. While the previous suit was pending, the petitioner applied under Section 10 of the Code of Civil Procedure, 1908 for stay of the later suit. The Trial Court rejected the application, leading to this petition under Article 227 of the Constitution. The core legal issue was whether the conditions of Section 10 CPC—direct and substantial identity of issues, same parties litigating under the same title, and jurisdiction of the previous court to grant the relief claimed in the later suit—were satisfied. The petitioner argued that all conditions were met, and the respondents did not appear. The High Court examined the pleadings and found that the defence in the previous suit was that the contract was executed as security for a loan, and the subsequent suit was brought precisely for a declaration to that effect. Thus, the issues in both suits were substantially the same, the parties were litigating under the same title, and the court in the previous suit had jurisdiction to grant the declaration sought. Consequently, the High Court held that the Trial Court erred in rejecting the stay application. The writ petition was allowed, the impugned order dated 16.04.2015 was quashed, and Regular Civil Suit No. 579 of 2012 was stayed until the decision in Regular Civil Suit No. 303 of 2012.

Headnote

A) Civil Procedure - Stay of Suit - Section 10 Code of Civil Procedure, 1908 - Where a previously instituted suit for specific performance of a contract is pending, and a subsequent suit is filed by the legal representatives of the deceased defendant seeking declaration that the same contract was a security document, the subsequent suit must be stayed as the issues are substantially the same, the parties are litigating under the same title, and the previous court has jurisdiction to grant the relief claimed in the subsequent suit. Held that the trial court's rejection of the stay application was erroneous; the subsequent suit is stayed pending disposal of the previous suit. (Paras 5-7)

Nature of Litigation

Writ petition under Article 227 of the Constitution of India challenging the Trial Court's order rejecting an application for stay under Section 10 of the CPC.

Remedy Sought

Petitioner sought stay of the subsequent suit (Regular Civil Suit No. 579 of 2012) pending decision in the previously instituted suit (Regular Civil Suit No. 303 of 2012, previously Special Civil Suit No. 156 of 2010) for specific performance of contract.

Filing Reason

The Trial Court rejected petitioner's application for stay, necessitating the writ petition.

Previous Decisions

The Trial Court (11th JMFC and CJJD) rejected the application for stay by order dated 16.04.2015.

Issues

Whether the subsequent suit (Regular Civil Suit No. 579 of 2012) for declaration that the contract is a security document should be stayed under Section 10 CPC, given the pending previously instituted suit (Special Suit No. 156 of 2010 new no. 303 of 2012) for specific performance of the same contract between the same parties litigating under the same title, and where the issues are substantially the same.

Submissions/Arguments

Petitioner argued that the issues in both suits are substantially the same, parties are litigating under the same title, and the previous court has jurisdiction to grant the relief claimed in the subsequent suit; therefore the subsequent suit should be stayed.

Ratio Decidendi

Under Section 10 of the Code of Civil Procedure, 1908, a subsequently instituted suit must be stayed if the matter in issue is directly and substantially the same as in a previously instituted suit between the same parties litigating under the same title, and the court in the previous suit has jurisdiction to grant the relief claimed in the subsequent suit.

Judgment Excerpts

Subsequent suit is brought, when previous suit was pending; issues in subsequent suit and issues in the previous suit are substantially the same; parties in both the suits are litigating under the same title and the Court in the previous suit have jurisdiction to grant relief claimed in the subsequent suit. The defence of late Shivaji in the previous suit is that suit contract was executed to secure the loan advanced by the petitioner/plaintiff to him and Shivaji's legal representatives brought the subsequent suit for cancellation of the very contract, it being executed as a security document against loan.

Procedural History

Petitioner (plaintiff) instituted Special Suit No. 156 of 2010 new no. 303 of 2012 for specific performance of contract dated 04.03.2005 against Shivaji Harale. Shivaji passed away on 02.05.2011 and his legal representatives were brought on record. These legal representatives brought Regular Civil Suit No. 579 of 2012 for declaration that the contract dated 04.03.2005 was a security document against the loan. The petitioner filed an application under Section 10 CPC for stay of the subsequent suit, which the Trial Court rejected on 16.04.2015. The petitioner then filed this writ petition under Article 227 of the Constitution.
