Case Note & Summary
The case arises from a Second Appeal filed by the original defendants, Barnes School and Bombay Education Society, against the judgment and order dated 2.9.2009 passed by the learned Adhoc District Judge-1, Nashik, which dismissed their appeal and confirmed the trial court's decree dated 8.2.2006. The respondent, Smt. Arzoo Allan Baker, an Assistant Teacher, had filed Special Civil Suit No. 260 of 2001 claiming Rs.1,99,397/- from the appellants under three heads: arrears due to the 5th Pay Commission (Rs.97,166/-), bonus for 1986-87 and 1999-2000 (Rs.33,866/-), and salary for periods in 2000-2001 (Rs.48,051/- and Rs.20,314/-). The trial court framed issues including whether the suit was bad for want of sanction under the Bombay Public Trust Act, 1950 (Issue 8), whether the plaintiff was entitled to relief (Issue 9), and whether the court had jurisdiction (Issue 10), answering all in favor of the plaintiff. The appellants appealed to the District Court, which dismissed the appeal without framing points for determination as required by Order 41 Rule 31 CPC, merely stating agreement with the trial court. The High Court framed the substantial question of law as whether the lower appellate court could dispose of the appeal without complying with Order 41 Rule 31 CPC. The High Court held that the requirement to frame points for determination is mandatory, even when the appellate court agrees with the trial court. The judgment of the lower appellate court was set aside, and the matter was remanded to the District Court for fresh disposal in accordance with law, with a direction to decide the appeal within six months. The Second Appeal was allowed, and the Civil Application was disposed of.
