The appellants (original plaintiffs) filed a suit in 1987 seeking declaration that an agreement dated 16th August 1984 for conducting a hotel business named 'Hotel Park View' had expired by efflux of time on 15th August 1987, and that the defendant's continued possession was illegal and amounted to trespass. The plaintiffs also sought mandatory injunction for handing over possession of the business along with furniture, fixtures, etc., and claimed liquidated damages at Rs.500 per day from 16.8.1987. The learned Single Judge dismissed the suit, holding that the agreement created a tenancy and the plaintiffs were not entitled to possession without following due process under rent laws. The Division Bench of the Bombay High Court allowed the appeal, set aside the Single Judge's judgment, and decreed the suit. The court held that the conducting agreement was not a lease and did not create any tenancy rights. The agreement had expired by efflux of time, and the defendant's continued possession was unauthorised. The court directed the defendant to hand over possession of the hotel business and all associated assets to the plaintiffs and pay liquidated damages at Rs.500 per day from 16.8.1987 till the date of handing over. Appeal allowed. Judgment and decree dated 12 December 2008 passed by the learned Single Judge in Suit No.3275/1987 is set aside. The suit is decreed. The defendant is directed to hand over possession of the hotel business 'Hotel Park View' together with furniture, fixtures, appliances, stock-in-trade etc. to the plaintiffs. The defendant shall pay liquidated damages at Rs.500 per day from 16.8.1987 till the date of handing over possession. The defendant shall pay costs of the suit and appeal.
