The applicant had been in possession since then. Respondent no. 3, Saraswatibai Govindrao Jamnerkar, allegedly filed a false complaint leading to the FIR. The police investigated and submitted a 'B' summary, but the Magistrate rejected it. The applicant argued that the dispute was civil in nature regarding title and possession, and no criminal offence was made out. The court, after hearing the parties, held that the dispute was essentially civil and the criminal proceedings were an abuse of process.
