The petitioner, Divisional Controller of Maharashtra State Road Transport Corporation, filed a writ petition challenging an order dated 26/8/2010 passed by the Civil Judge, Senior Division, Chandrapur, which disposed of the petitioner's application (Exh. 13) and the Darkhast (Exh. 1) filed by respondent no.2. The respondent no.2 had filed execution proceedings for a judgment and decree dated 30/9/1987 in L.A.C. No. 9/1986, registered as Special Execution Case No. 47/2010, claiming a total amount of Rs.13,63,635/-. The petitioner filed an application for dismissal of the Darkhast on the ground that respondent no.2 had been overpaid by Rs.89,627/-. The petitioner's calculation was based on the fact that the Reference Court had initially fixed land costs at Rs.85 per square metre, on which basis the petitioner deposited Rs.6,78,526/-, which was withdrawn by respondent no.2. On remand, the Reference Court fixed compensation at Rs.72 per square metre. The petitioner argued that the amount already paid exceeded the amount due under the revised rate. The executing court rejected the petitioner's objections and allowed the execution to proceed. The High Court held that the award had attained finality and the decree holder had withdrawn the compensation. The executing court cannot go behind the decree. The objections raised by the petitioner were not maintainable as they amounted to challenging the decree itself. The writ petition was dismissed. Rule discharged. No order as to costs.
