Case Note & Summary

The petitioners, members and trustees of Shri Sant Kabir Bahu-Udeshiya Shishan Prasarak Mandal, an educational trust, challenged the order dated 11th September 2009 passed by the Joint Charity Commissioner, Latur, which rejected their change report regarding the election of the trust committee. The dispute arose from earlier elections held in 2005, which led to two change reports (No. 494 of 2005 and 558 of 2005) and a previous writ petition (W.P. No. 4969 of 2007). In that petition, the High Court directed the Deputy Charity Commissioner to decide the change reports within two months and to conduct elections. The Deputy Charity Commissioner, by order dated 14th February 2008, rejected both change reports and appointed an Inspector from his office as Returning Officer to hold elections after the appeal period. The Returning Officer conducted elections on 19th August 2008, in which the petitioners were elected to various posts: Petitioner No. 2 as Secretary, Petitioner No. 3 as Joint Secretary, Petitioner No. 4 as Treasurer, and others as members. The petitioners submitted a change report to the Deputy Charity Commissioner, but the Joint Charity Commissioner, by the impugned order, rejected it on the ground that the election was not conducted as per the court's directions and that the petitioners were not validly elected. The High Court, after hearing the parties, found that the election was conducted by a Returning Officer appointed by the Deputy Charity Commissioner as per the earlier order, and the petitioners were duly elected. The court held that the Joint Charity Commissioner's order was contrary to the earlier directions and the election results. Consequently, the High Court allowed the writ petition, quashed the impugned order, and directed the Deputy Charity Commissioner to accept the change report submitted by the petitioners.

Nature of Litigation

Writ petition challenging order of Joint Charity Commissioner rejecting change report regarding election of trust committee.

Remedy Sought

Quashing of order dated 11th September 2009 passed by Joint Charity Commissioner, Latur, and direction to accept change report.

Filing Reason

The Joint Charity Commissioner rejected the change report submitted by the petitioners regarding the election of the trust committee, claiming the election was not conducted as per court directions.

Previous Decisions

Earlier, in Writ Petition No. 4969 of 2007, this Court directed the Deputy Charity Commissioner to decide change reports and conduct elections. The Deputy Charity Commissioner rejected both change reports on 14th February 2008 and appointed a Returning Officer to hold elections. Elections were held on 19th August 2008, and petitioners were elected.

Issues

Whether the Joint Charity Commissioner was justified in rejecting the change report on the ground that the election was not conducted as per the directions of this Court. Whether the election held on 19th August 2008 was valid and in compliance with the earlier order.

Submissions/Arguments

Petitioners argued that the election was conducted by a Returning Officer appointed by the Deputy Charity Commissioner as per the court's directions, and they were validly elected. Respondents contended that the election was not conducted as per the directions and the petitioners were not validly elected.

Ratio Decidendi

The election of the trust committee was conducted by a Returning Officer appointed by the Deputy Charity Commissioner as per the earlier directions of this Court, and the petitioners were validly elected. The Joint Charity Commissioner's order rejecting the change report was contrary to the earlier directions and the election results, and therefore, the impugned order was liable to be set aside.

Judgment Excerpts

The Deputy Charity Commissioner, as per the directions of this Court, decided the change reports by order dated 14th February 2008, thereby rejected both the change reports. The Returning Officer conducted the election and same were completed/held on 19th August 2008. In the said election Petitioner No. 2 was elected as Secretary, Petitioner No. 3 was elected as Joint Secretary, and petitioner No. 4 as Treasurer.

Procedural History

The dispute originated from elections held in 2005, leading to two change reports. The matter came before this Court in Writ Petition No. 4969 of 2007, which directed the Deputy Charity Commissioner to decide the change reports and conduct elections. The Deputy Charity Commissioner rejected the change reports on 14th February 2008 and appointed a Returning Officer. Elections were held on 19th August 2008, and petitioners were elected. The petitioners submitted a change report, which was rejected by the Joint Charity Commissioner on 11th September 2009. The petitioners then filed the present writ petition.
