The petitioners, members and trustees of Shri Sant Kabir Bahu-Udeshiya Shishan Prasarak Mandal, an educational trust, challenged the order dated 11th September 2009 passed by the Joint Charity Commissioner, Latur, which rejected their change report regarding the election of the trust committee. The dispute arose from earlier elections held in 2005, which led to two change reports (No. 494 of 2005 and 558 of 2005) and a previous writ petition (W.P. No. 4969 of 2007). In that petition, the High Court directed the Deputy Charity Commissioner to decide the change reports within two months and to conduct elections. The Deputy Charity Commissioner, by order dated 14th February 2008, rejected both change reports and appointed an Inspector from his office as Returning Officer to hold elections after the appeal period. The Returning Officer conducted elections on 19th August 2008, in which the petitioners were elected to various posts: Petitioner No. 2 as Secretary, Petitioner No. 3 as Joint Secretary, Petitioner No. 4 as Treasurer, and others as members. The petitioners submitted a change report to the Deputy Charity Commissioner, but the Joint Charity Commissioner, by the impugned order, rejected it on the ground that the election was not conducted as per the court's directions and that the petitioners were not validly elected. The High Court, after hearing the parties, found that the election was conducted by a Returning Officer appointed by the Deputy Charity Commissioner as per the earlier order, and the petitioners were duly elected. The court held that the Joint Charity Commissioner's order was contrary to the earlier directions and the election results. Consequently, the High Court allowed the writ petition, quashed the impugned order, and directed the Deputy Charity Commissioner to accept the change report submitted by the petitioners.
