Rule 35(1) states that in cases where the Management desires to suspend an employee, he shall be suspended only with the prior approval of the appropriate authority mentioned in rule 33. The court, comprising Justices S.A. Bobde and Mrs. Mridula Bhatkar, heard the matter and delivered an oral judgment per S.A. Bobde, J. The court accepted the petitioner's contention, holding that the Headmaster is not the 'Management' as contemplated under Rule 35(1). Therefore, the Headmaster had no authority to suspend the petitioner. Consequently, the court quashed the suspension order dated 16/9/2010.
