The petitioner, Sonalaxmi Machhimar Sahakari Society Ltd., a cooperative society registered under the Maharashtra Cooperative Societies Act, 1960, challenged the lease agreement dated 19th September, 2001 executed by the Thane Municipal Corporation with respondent No.6, Precision Fisheries, for cleaning, fishing and boating at Masunda Lake in Thane city. The lease was for a period of 25 years. The petitioner had previously held a boating contract at the same lake, which was about to expire. The petitioner contended that the lease was granted without any public advertisement or invitation of tenders, and was contrary to Resolution No. 201 dated 19th July, 2001 passed by the Corporation. The petitioner sought a declaration that the lease was illegal and unconstitutional, and directions to the Corporation to invite tenders.
