The High Court of Judicature of Bombay, Bench at Aurangabad, delivered a common oral judgment disposing of four criminal appeals: three filed by convicted accused persons (original accused nos. 1–5, 9, and 11) and one by the State seeking enhancement of sentence and conviction under Section 302 IPC. The appeals arose out of the judgment and order dated 22.12.2007 passed by the Ad Hoc Additional Sessions Judge-4, Aurangabad in Sessions Case No. 6/2006. The case stemmed from a land boundary dispute at Bidkin, Taluka Paithan, District Aurangabad, between the deceased Gorakh and Machhindra Chaudhari and the accused persons. On 29.01.2006, at about 10:30 a.m., the accused along with unknown persons armed with deadly weapons entered the field of Gorakh while he was irrigating his wheat crop. Accused no.1 Sk. Karim initiated a quarrel over damage to the common boundary, following which accused nos.3, 4, and 11 inflicted stick and axe blows on Gorakh’s head, legs, wrists, and palms. When Gorakh’s brother Machhindra and his wife Mangala rushed to the spot, they were also assaulted. All three collapsed and were taken to the Primary Health Centre, Bidkin, where Dr. Govardhan Doiphode examined them and certified Gorakh fit to give a statement. Based on Gorakh’s dying declaration recorded by PSI Tulshiram Dhumal, Crime No. 9/2006 was registered for offences under Sections 143, 147, 148, 149, 324, 323, 504 IPC. Gorakh died on 30.01.2006 while undergoing treatment at Ghati Hospital, Aurangabad, and Machhindra succumbed on 04.02.2006. The investigation led to the arrest of accused persons, recovery of weapons at their instance, and collection of medical and documentary evidence. The charge-sheet initially filed against only nine accused was later supplemented after the arrest of three more. The trial court framed charges under Sections 302, 143, 147, 148, 324, 323, 504 read with 149 and 120-B IPC. After examining 15 witnesses including panchas, medical officers, and the investigating officer, the trial court convicted the accused under Section 304 Part I read with Section 149 and Sections 147, 148 IPC, while acquitting them of the other charges. Various accused were sentenced to rigorous imprisonment ranging from 3 to 8 years and fines. The appeals before the High Court were heard together, and the judgment was pronounced on 1 September 2010, but the specific outcome of the appeals—whether convictions were upheld, modified, or set aside—is not discernible from the available text.

Agricultural land of deceased Gorakh Chaudhari, Machhindra Chaudhary and the accused persons are situated adjacent to each other at Bidkin, TqPaithan, DistAurangabad. There was old boundary dispute between the parties. On 29th January 2006 at about 6.00 a.m. or so, deceased Gorakh was giving water to the standing wheat crop in the said field. At about 10.30 a.m. the accused along with 4/5 unknown persons, armed with deadly weapons, entered in the field and accused No.1 Shaikh Karim took up quarrel with deceased Gorakh on account of damage to the common boundary. On the basis of the said statement (Exhibit66) an offence at Crime No.9/2006 was registered with Bidkin police station against the appellants and others for an offence punishable u/s 143, 147, 148, 149, 324, 323, 504 of the Indian Penal Code.

Procedural History

Incident took place on 29.01.2006 at Bidkin. FIR Crime No. 9/2006 registered at Bidkin Police Station under Sections 143, 147, 148, 149, 324, 323, 504 IPC. After the death of Gorakh on 30.01.2006, Section 302 IPC was added. Accused nos. 1-5 were arrested on the same day; subsequent arrests of other accused took place later. After investigation, charge-sheet was filed initially against accused nos. 1-9; supplementary charge-sheets were filed against accused nos. 10-12 upon their arrest. The cases were amalgamated into Sessions Case No. 6/2006. Charges were framed initially on 20.06.2006 and altered on 20.02.2007 to include all 12 accused for offences under Sections 302, 143, 147, 148, 324, 323, 504 read with 149 and 120-B IPC. Trial commenced and 15 witnesses were examined. On 22.12.2007, the Ad Hoc Additional Sessions Judge-4, Aurangabad convicted the accused under Section 304 Part I r/w 149 and Sections 147, 148 IPC, while acquitting them of other charges. Aggrieved by the conviction, the accused filed Criminal Appeals No. 230/2008, 231/2008, and 482/2007. The State filed Criminal Appeal No. 264/2008 seeking enhancement of sentence and conviction under Section 302 IPC. All appeals were heard together and disposed of by the High Court of Bombay, Aurangabad Bench, on 01.09.2010.
