The appellant, Ramdas Verlekar, filed a claim petition before the Motor Accident Claims Tribunal, South Goa, Margao, seeking compensation of Rs. 6,91,213.32 for injuries sustained in a motor vehicle accident on 30th April 1997. The appellant was travelling in his own maruti van when a maruti car owned by respondent No.1 dashed into his vehicle on the National Highway at Nuvem. The appellant suffered a fracture in the leg and dislocation of the right hip. The Tribunal held that the accident was caused due to the negligence of the driver of the car belonging to respondent No.1 and awarded compensation of Rs. 1,75,478/-. The appellant appealed for enhancement. The High Court considered the evidence including medical bills, loss of income, pain and suffering, and need for future treatment. The Court found that the Tribunal had not adequately compensated the appellant for medical expenses, loss of income during treatment, pain and suffering, and future treatment. The High Court enhanced the compensation by Rs. 1,24,522/-, making the total compensation Rs. 3,00,000/-. The Court directed the Insurance Company to pay the enhanced amount with interest at 9% per annum from the date of the claim petition till realization.
