The petitioner, Western Coalfields Ltd., participated in an auction for sand ghats in Yavatmal district conducted by the State of Maharashtra. The petitioner's bid of Rs.18,22,275 was accepted, and he deposited 1/4th of the amount. However, he failed to deposit the remaining 75% within the stipulated 15 days. Consequently, the respondents cancelled the bid and issued a communication dated 19.11.2009 and a demand notice dated 3.12.2009 calling upon the petitioner to pay 75% of the bid amount. The petitioner challenged this demand. The court examined the auction conditions, particularly sub-clauses (7) and (8) of Clause 3. Sub-clause (7) provides that on failure to execute the agreement, the 1/4th amount shall be forfeited and the sand ghat shall be reauctioned.
