The petitioner, Madhusudan Anandrao Chowdhari, was an employee of the Zilla Parishad, Jalna, working in the Finance Department. He sought promotion to the post of Divisional Accountant/Assistant Accounts Officer with effect from 22/03/1990, the date of passing of the Maharashtra Zilla Parishad, Finance Accounts Services Examination Class-III. He also challenged Rule 5 read with Appendix XI of the Maharashtra Zilla Parishad District Services (Recruitment) Rules, 1967, which restricted promotion/absorption in M.F. & A.S. Service Class III – Grade I only to incumbents working in M.F. & A.S. Services Class-III -Grade-II.
