The petitioner, Madhav s/o Ramchandra Bende, was an employee of the Forest Development Corporation Ltd. He was charged with preparing false documents and using them for misappropriation of property of the Corporation and for dereliction of duty, thereby causing loss to the Corporation. The Disciplinary Authority decided to terminate his services. The petitioner preferred an appeal before the appellate authority, i.e., the Regional Manager, Nagpur Region of the Corporation. In the appeal, the petitioner raised a ground that the Disciplinary Authority did not give him any opportunity for defending himself. The appellate authority, instead of examining whether such an opportunity was given to him or not, asked the petitioner if he had any document for rebutting the charges against him, to which he replied in the negative. The appellate authority then concluded that the allegations made against the petitioner stand proved. The petitioner challenged the order of the appellate authority dismissing his appeal by way of a writ petition before the Bombay High Court. The High Court held that the appellate authority could not have decided the appeal in the manner it did. It was bound to examine the question raised by the petitioner regarding the denial of opportunity of hearing. The court found that the appellate authority's approach was erroneous and set aside the order of the appellate authority. The court directed the appellate authority to decide the appeal afresh in accordance with law, after giving an opportunity of hearing to the petitioner.
