The petitioner, Arun Dnyandeo Late, a trained graduate teacher possessing B.A. and B.P.Ed. qualifications, was appointed as an Assistant Teacher by respondent No. 4 (Gramvikas Shikshan Mandal) on 19th January 1999, in the pay scale of Rs. 1400-2600, which was the then prevailing scale for trained graduate teachers. The appointment was on probation for two years. The school forwarded a proposal to the Education Officer (respondent No. 3), who granted approval to the appointment with effect from 22nd January 1999 in the same pay scale, but subject to guidance from the Deputy Director of Education. Around the same time, respondent No. 5, Chandrakant Daulatrao More, who possessed B.A., D.Ed. qualifications, staked his claim to the higher pay scale for trained graduate teachers and was granted the same. Subsequently, the Education Officer sought to downgrade the petitioner's pay scale to Rs. 1200-2040, treating B.P.Ed. as not equivalent to B.Ed., and issued a show cause notice to the school. The petitioner challenged this action by filing a writ petition. The Court considered the submissions of the parties, including the petitioner's argument that B.P.Ed. is a training qualification equivalent to B.Ed. and that he was entitled to the higher pay scale from the date of appointment. The respondents argued that B.P.Ed. was not recognized as equivalent to B.Ed. for the purpose of higher pay scale.
