The petitioner, Kazi Rukhsana Mohomed, was appointed as a Demonstrator (Part-Time) in Maharashtra College in 1969 and later as a Full-Time Demonstrator in 1970-71. A Government Resolution (G.R.) dated 25.10.1977 revised pay scales and upgraded Demonstrators to Lecturers with effect from the academic year 1975-76, provided they possessed the prescribed qualifications. The petitioner possessed a B.Sc. (Hons) degree but not a Master's degree. The G.R. required teachers recruited on or before 3rd October 1975 who lacked minimum qualifications to attain them within five years. The petitioner was upgraded to Lecturer in 1975-76. Upon retirement, she was denied pension on the ground that her service as Demonstrator prior to upgrade was not counted as qualifying service. The court examined the G.R. and the pension rules. It held that the upgrade was automatic and not a fresh appointment, and that the petitioner's service as Demonstrator prior to the upgrade must be counted for pension. The court directed the respondents to count her entire service from 1969 for pension and to pay her pension and other retiral benefits within three months, failing which interest at 6% per annum would be payable.
