Procedural History

The Commissioner of Sugar directed enquiry under Section 83 of Maharashtra Co-operative Societies Act, 1960 on 22-02-2002. The Chairman (appellant) challenged it before the Minister and obtained stay. Subsequently, the Commissioner ordered liquidation on 22-05-2002. A shareholder filed Writ Petition No. 1199 of 2003 seeking various reliefs but no relief was granted. Both the Chairman's revision against enquiry and the shareholder's revision against liquidation were heard together by the Minister, who passed a common order on 01-06-2005 dismissing one of the revisions.
