Case Note & Summary
The present Public Interest Litigation was filed by 14 petitioners, including residents of Versova, Mumbai, and the Jai Bharat Cooperative Housing Society Limited, challenging the notification dated 18.01.2019 issued by the Ministry of Environment, Forest and Climate Change (MoEF&CC) under the Coastal Regulation Zone (CRZ) Notification, 2011. The petitioners alleged that the impugned notification reclassified certain areas in Versova from CRZ-I (ecologically sensitive) to CRZ-II/III (built-up area/rural area), which would lead to destruction of mangroves and violate CRZ norms. They sought quashing of the notification and a direction to maintain the status quo. The respondents, including the Union of India and the State of Maharashtra, defended the notification, stating that it was issued after a detailed scientific study and due consideration of all relevant factors, including the presence of mangroves. The court examined the notification and the CRZ Notification, 2011, and found that the classification was in accordance with the law. The court noted that the impugned notification had been issued after following the due process, including public consultation and expert committee review. The court held that there was no violation of CRZ norms and that the petitioners had failed to make out a case for interference. The PIL was dismissed with no order as to costs.
