The applicant, Dr. Shriram Madhusudan Bhuskute, the Principal of Bhawabhuti Mahavidyalaya, Amgaon, filed an application under Section 482 of the Code of Criminal Procedure, 1973, seeking quashing of FIR No. 371/2019 registered at Amgaon Police Station, Gondia, for offences under Section 354-A of the Indian Penal Code, 1860, and Sections 3(1)(r) and 3(1)(w)(ii) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. The applicant contended that the allegations were vague, contradictory, and lacked essential ingredients of the alleged offences, and that the FIR was an abuse of process of law. The court examined the FIR and the charge-sheet and found that the allegations did not constitute 'unwelcome physical contact' or 'demand for sexual favours' under Section 354-A IPC, as the alleged abusive language had no sexual overtone. Regarding the SC/ST Act, the court noted that the complainant herself admitted that the applicant never used her caste name, and the alleged insult was not shown to be on account of her caste. The court held that the ingredients of Sections 3(1)(r) and 3(1)(w)(ii) were not made out. Consequently, the court quashed the FIR and all consequential proceedings.
