The appellant, an Upper Division Clerk (In-charge Cashier) at the Passport Office, Panaji-Goa, was convicted by the Special Judge, North Goa at Panaji in Special Criminal Case No.7/2005 for the offence under Section 13(1)(c) of the Prevention of Corruption Act, 1988, and sentenced to one year rigorous imprisonment and a fine of Rs.500. He was acquitted of offences under Section 13(1)(d) of the said Act and Section 420 of the Indian Penal Code. The charge alleged that the appellant abused his official position by obtaining a scooter advance of Rs.27,600 and using it for other purposes, failing to deduct repayment from his salary, thereby misappropriating Rs.38,916 including interest, and also availed leave travel concession advance of Rs.10,000 without performing any journey. The appellant challenged the conviction. The High Court of Bombay at Goa heard the appeal. The appellant's counsel argued that the prosecution did not allege or prove entrustment of property, and the case was merely a loan default, which does not attract the provisions of the Prevention of Corruption Act. The court agreed, holding that the ingredients of Section 13(1)(c) require dishonest misappropriation or conversion of property entrusted to the accused. Since the advances were loans, not entrustment, the conviction was unsustainable. The court allowed the appeal, set aside the conviction and sentence, and acquitted the appellant.
