The appellant, Mohammad Siddaqi, was convicted by the Children's Court for the State of Goa at Panaji for committing rape, grave sexual assault, penetrative sexual assault, incest, and aggravated penetrative sexual assault on his minor stepdaughter, aged between 9 and 14 years, over a period from November 2009 to November 2014. The prosecution alleged that the appellant forcibly had sexual intercourse and oral sex with the victim, and also showed her pornographic videos on his mobile phone. The appellant's wife, the biological mother of the victim, was also charged for being aware of the acts and failing to report them, and for selling two minor children and employing the victim in the house of one Mr. Lobo. The wife was acquitted of some charges but convicted under Section 2(m)(i) punishable under Section 8(2) of the Goa Children's Act, 2003. The appellant appealed against his conviction and sentence. The High Court of Bombay at Goa heard the appeal. The court considered the submissions of the appellant's counsel, who argued for reduction of sentence, and the Additional Public Prosecutor for the State. The court upheld the conviction, finding the victim's testimony credible and corroborated by medical evidence. However, the court reduced the sentence for the offences under the Goa Children's Act, 2003 to 10 years, while maintaining the sentence for the offences under the POCSO Act. The court also noted that the appellant's wife had already undergone the sentence imposed on her.
