Case Note & Summary
The appellant, Siddharth Dupare, was a labourer who sustained grievous injuries in a motor vehicle accident when the jeep he was traveling in, driven rashly and negligently, collided with a State Transport Bus on Ridhora-Kondhali road, Nagpur. He suffered 50% permanent disability in his right leg. He filed a claim petition under Section 166 of the Motor Vehicles Act, 1988, seeking Rs.2,30,000/- (restricted to Rs.2,00,000/-) under various heads including medical expenses, pain and suffering, loss of earning and future earning, and special diet. The Motor Accident Claims Tribunal, Nagpur, partly allowed the claim and awarded Rs.83,500/-: Rs.50,000/- for future income loss due to permanent disability, Rs.13,500/- for medical treatment expenses, Rs.10,000/- for pain and suffering, and Rs.10,000/- for special diet. Dissatisfied, the appellant appealed to the High Court for enhancement. The High Court found the Tribunal's award inadequate. Considering the nature of injuries, 50% permanent disability, and the appellant's occupation as a labourer, the court enhanced the compensation. It increased the amount for pain and suffering from Rs.10,000/- to Rs.30,000/-, special diet from Rs.10,000/- to Rs.20,000/-, and loss of future income from Rs.50,000/- to Rs.1,00,000/-. The total compensation was enhanced from Rs.83,500/- to Rs.1,53,500/-. The court directed the respondent insurance company to pay the enhanced amount with interest at 6% per annum from the date of the claim petition till realization, within six weeks. The appeal was partly allowed.
