Case Note & Summary
The petitioner, Dr. Anil D. Garje, completed his M.Sc. in Physics in 1993 and was appointed as a Lecturer in Physics at Sou. Venutai Chavan Polytechnic College on 7 May 1994. His appointment was approved on 4 August 1997. He earned an M.Phil in 2001 and a Ph.D. in 2008. He served continuously at the Polytechnic College from 1 July 1995 to 30 November 2009, a period of over 14 years. On 25 November 2009, he was appointed as a full-time Lecturer in Physics at Respondent No. 4 College (Sir Parashurambhau College), and he resigned from his previous post on 30 November 2009. In 2010, the UGC Regulations, 2010 came into force. Between 2012 and 2017, the petitioner made several representations to Respondent No. 2 (Joint Director of Higher Education) to consider his previous 14 years of service for benefits under the Career Advancement Scheme (CAS). In August 2017, Respondent No. 2 sought explanations, which the petitioner provided on 7 September 2017. However, on 7 December 2017, Respondent No. 2 rejected the petitioner's request. The petitioner then filed a writ petition before the Bombay High Court. The legal issue was whether the petitioner's prior service in a Polytechnic College could be counted as 'approved service' for CAS under the UGC Regulations, 2010. The petitioner argued that his prior service should be considered as he was qualified and had served continuously. The respondents contended that the UGC Regulations apply only to university and college teachers, not to polytechnic teachers governed by AICTE, and that CAS benefits require service in the same institution or under the same employer. The court analyzed the UGC Regulations, 2010, particularly the definition of 'approved service' and the conditions for CAS. It noted that the petitioner's prior service was in a Polytechnic College under AICTE regulations, which are different from UGC regulations. The court held that the petitioner's previous service could not be treated as 'approved service' under the UGC Regulations, as the regulations require service in the same institution or under the same employer for CAS. The court dismissed the writ petition, finding no merit in the petitioner's claim.
Headnote
A) Service Law - Career Advancement Scheme - Approved Service - UGC Regulations, 2010 - The petitioner, a Lecturer in Physics, sought counting of his prior 14 years of service in a Polytechnic College for CAS benefits under UGC Regulations, 2010. The court held that service in a Polytechnic College, governed by the All India Council for Technical Education (AICTE), cannot be treated as 'approved service' under the UGC Regulations, which apply to university and college teachers. The regulations require service in the same institution or under the same employer for CAS, and the petitioner's prior service was in a different type of institution with different governing regulations.
