Case Note & Summary

The petitioner, Hartex Tubes Pvt. Ltd., challenged the judgment of the First Labour Court, Nagpur, dated 26.2.2007, which declared the dismissal of respondent no. 1 (workman) illegal and directed his reinstatement with continuity of service and 25% back wages. The workman had filed Complaint (ULPA) 493 of 1997 alleging that he was appointed as Helper on 2.3.1992, later promoted to Guli Operator, and that his service record was clean. He claimed that the employer, engaged in manufacturing rubber tubes with about 30 employees, was habituated to victimizing employees to stifle dissent. The workman was suspended on 12.2.1996 and issued a charge sheet on 26.3.1996 alleging that he deliberately kept rubber tubes on the ground instead of on a table and that he abused and threatened one Shri Mukesh Batham when questioned. The workman contended that the enquiry was farcical and conducted in breach of principles of natural justice, and that the action was initiated because he was named as a defence witness in an enquiry against a colleague. The Labour Court found the dismissal illegal and ordered reinstatement with 25% back wages. The employer's revision before the Industrial Court was dismissed on 10.11.2014. The High Court, in the present writ petition, examined the concurrent findings of the Labour Court and Industrial Court. The court noted that the Labour Court had considered the evidence and found that the enquiry was not fair and proper. The High Court held that the findings of fact recorded by the Labour Court and Industrial Court were not perverse and did not warrant interference under Article 226 of the Constitution. The petition was dismissed, and the order of reinstatement with 25% back wages was upheld.
