The petitioners, Jaibunissa and Abdul Hamid Khan, were tenants of premises owned by Salimuiddin Khan. Salimuiddin had inducted them on a long lease. After Salimuiddin's whereabouts were unknown for over seven years, his sons, the respondents, filed Regular Civil Suit No.387/1989 seeking a declaration of his civil death, which was decreed on 02.02.1990. The respondents then terminated the lease and filed Regular Civil Suit No.945/1997 for eviction against the petitioners. That suit was decreed, and the decree was confirmed in appeal and reached finality. The respondents filed execution proceedings (Regular Darkhast No.112/2008). The petitioners filed an application (Exhibit-31) under Section 47 read with Section 151 and Order XXI Rule 29 of the Code of Civil Procedure, 1908, contending that the civil death declaration was obtained fraudulently and that the decree for eviction was therefore not executable. The executing court dismissed the application, holding that the objections were not maintainable as the decree had attained finality. The petitioners challenged this order by way of the present writ petition. The High Court dismissed the petition, holding that objections under Section 47 CPC cannot be raised after the decree has become final, and that the petitioners are estopped from challenging the decree in execution. The court also held that Order XXI Rule 29 CPC does not apply to stay execution of a decree that is already final. The court found no merit in the petition and dismissed it, making rule discharged.
