The petitioner, Aasiya Mahamadyunnus Gavandi, filed a writ petition challenging the order dated 29th/31st July 2020 passed by the District Caste Certificate Verification Committee, Sangli, which rejected her claim for a caste validity certificate for 'Momin' caste, recognized as Other Backward Class (OBC) under Government Resolution dated 16th August 1977. The petitioner had contested the Gram Panchayat election in September 2018 and gave an undertaking to submit her caste validity certificate. She applied to the Committee based on a caste certificate issued by the Sub-Divisional Officer, Miraj on 6th September 2018. The matter was referred to the Vigilance Cell, which investigated and submitted a report. However, the Committee rejected her claim solely on the ground that she did not possess documents prior to 13th October 1967. The petitioner contended that in the Muslim community, there is no practice of mentioning caste or sub-caste in documents, and the Committee failed to appreciate the documentary evidence and the vigilance report. The respondents opposed the petition. The High Court observed that the Committee had not properly considered the vigilance report and other documents, and that the absence of pre-1967 documents cannot be the sole ground for rejection, especially in the context of Muslim caste claims. The Court set aside the impugned order and remitted the matter to the Committee for fresh consideration, directing the Committee to decide the caste claim afresh within three months, after giving an opportunity of hearing to the petitioner and considering all documents and the vigilance report.
