The petitioners, including Sangramsinh Bhausaheb Ghule (petitioner no.1), Marutrao Ghule Patil Shikshan Sanstha (petitioner no.2 society), and the Headmaster of Jijamata Secondary & Higher Secondary School (petitioner no.3), filed a writ petition challenging the order dated 24.07.2018 passed by the Education Officer (Secondary), Zilla Parishad, Ahmednagar (respondent no.2), rejecting the proposal for approval of promotion of petitioner no.1 from the post of peon to junior clerk. Petitioner no.1 was initially appointed as a peon on 01.09.2005 on a clear and sanctioned post, and the Education Officer had granted approval to that appointment. Subsequently, when a junior clerk was promoted to senior clerk, the post of junior clerk fell vacant. The school management, considering petitioner no.1's placement in the common seniority list and roster, and also giving sympathetic consideration to his 50% handicap, resolved to promote him to the vacant post of junior clerk in a meeting on 01.03.2015. Petitioner no.1 was appointed as junior clerk vide order dated 13.02.2015. However, the proposal dated 16.02.2018 seeking approval to this promotion was rejected by the Education Officer by order dated 24.07.2018. The petitioners challenged this rejection. The court observed that the Education Officer's order did not specify any particular rule under the Maharashtra Employees of Private Schools (Conditions of Service) Rules, 1981 (MEPS Rules) that was violated. The court noted that the Education Officer's role is limited to verifying whether the promotion is in accordance with the MEPS Rules and that rejection on grounds not specified in the rules is unsustainable. The court also noted that the promotion was based on seniority and roster, and the sympathetic consideration for the handicap was an additional factor.
