On 09/04/2002, officials of the Superintendent of State Excise inspected the premises and found breaches: unauthorized alterations in the licensed premises, a vast difference in stock leading to shortages, and possession of 1680 x 180 mm bottles of 50 U.P. rum and 12 x 750 mm bottles of Diplomat Whisky without transport permit. In this Letters Patent Appeal, challenge is to the Judgment and order dated 11/12/2009 passed by the learned Single Judge in Writ Petition No.2796/2005, whereby the learned Single Judge dismissed the writ petition and thereby, confirmed the order dated 18/05/2005 passed by the respondent No.2.
The respondent No.3 on the basis of material collected during the course of enquiry, issued Show Cause Notice dated 30/01/2004 to the appellant and called upon him to show cause as to why his license should not be cancelled.
The appellant filed his reply dated 20/02/2004 and tried to explain the position. The respondent No.3 fixed the date of hearing on 16/03/2005. The appellant did not appear on the said date. The respondent No.3, therefore, proceeded ex parte and passed the order dated 16/03/2005 cancelling the license.
