The writ petition, originally filed as a Public Interest Litigation, challenged the decisions of Baramati Municipal Council and the State of Maharashtra regarding the allotment of municipal land. The petitioner, Surendra Shamsundar Jeware, sought to quash Council Resolution No.18 dated 28 May 2021, by which the Council resolved to allot an area of 3,408 square metres to respondent no.7, Natraj Natya Kala Mandal, a public trust. He also challenged Resolution No.5 dated 12 July 2021, which resolved to apply for change of user of the lands, and the State Government’s approval dated 18 August 2021 permitting the long‑term lease. The lands, bearing City Survey Nos.908 to 914, were reserved partly for recreational activities and open space and partly for commercial purpose under the development plan. The trust had occupied nearby irrigation department land and agreed to surrender it for a canal beautification project, thus seeking the council’s land for continuing its cultural activities. The petitioner objected, contending that the trust was established by a council member, had encroached on the writ land, and was ineligible for allotment, and that the council had assured him previously that the land would be protected. The Chief Officer’s note to the General Meeting recognized the need for State Government approval under Section 92 of the Maharashtra Municipal Councils, Nagar Panchayats and Industrial Townships Act, 1965 and the Maharashtra Municipalities (Transfer of Immovable Property) Rules, 1983. The court, after hearing preliminary arguments, issued rule and made it returnable forthwith. The matter was reserved for judgment.
